2. Processing frame
2.1 Sources and categories of data
We process the data that you have sent us in connection with your application in order to check your suitability for the position (or any other open positions in our companies) and to carry out the application process. In addition, we process personal data which you have published on the Internet and which we are permitted to process in accordance with data protection legislation. This includes, for example, your CV, career history, etc.
2.2 Purposes and legal bases of the processed data
We process your personal data in compliance with the provisions of the EU General Data Protection Regulation (GDPR), the new Federal Data Protection Act (BDSG-Neu) and all other relevant laws (e.g. StVG, OWiG).
The legal basis for the processing of your personal data in this application procedure is primarily Art. 6 para. 1 lit. b) GDPR in p.p. m. § 26 BDSG. Accordingly, the processing of data required in connection with the decision on the establishment of an employment relationship is permitted.
This also includes the processing of communication data (user details, content data, connection data and comparable data) as part of the application process through the use of internet-based communication tools.
Should the data be required for legal prosecution after completion of the application process, data processing may be carried out on the basis of the requirements of Art. 6 GDPR, in particular to safeguard legitimate interests in accordance with Art. 6 para. 1 lit. f) GDPR. Our interest then lies in the assertion or defence of claims.
We may process your personal communication data (user details, content data, connection data and comparable data) as part of the application process, in particular the digital conduct of job interviews, if the contract is initiated with the help of internet-based communication tools, in order to simplify the organisation of the application process and to be able to adapt it to the current needs of applicants and employers.
Furthermore, your voluntarily granted consent may be the legal basis for data processing in accordance with Art. 6 para. 1 lit. a) GDPR (e.g. inclusion in the applicant pool, newsletter for new job offers). The consent given can be revoked at any time with effect for the future.
If we process your personal data for a purpose not mentioned above, we will inform you in advance.
2.3 Consequences of not providing data
As part of your application, you must provide the personal data that is required to establish the employment relationship or that we are legally obliged to collect.
2.4 Automated decisions in individual cases including profiling (Art. 22 GDPR)
We do not use any purely automated decision-making processes. Should we use such a procedure in individual cases in the future, we will inform you of this separately if this is required by law.
In some circumstances, we may process your data with the aim of evaluating certain personal aspects (profiling). Information on nationality and special categories of personal data in accordance with Art. 9 GDPR are not processed.
3. Recipient of the data
3.1 Within the EU/EEA
With us, only those persons and positions (e.g. Department, Managing Director, HR department) your personal data that they require for the application process.
Your applicant data will be reviewed by the HR department upon receipt of your application. Suitable applications are then forwarded internally to the department managers responsible for the respective open position. The next steps are then agreed. Only those persons have access to your data who need it for the proper course of our application procedure.
We also use a specialised software provider for the application process. The latter acts as a service provider for us and may also obtain knowledge of your personal data in connection with the maintenance and servicing of the systems. We have concluded a so-called order processing contract with this provider, which ensures that the data processing is carried out in a permissible manner.
3.2 Outside the EU/EEA
Data is not transferred to recipients outside the EU/EEA.

4. Storage periods
Applicants' data will be deleted after 4 months in the event of rejection.
In the event that you have consented to further storage of your personal data for further job advertisements or for a duration that exceeds the current application process, we will transfer your data to our applicant pool. The data will be deleted there after two years.
If you have been accepted for a position as part of the application process, the data from the applicant data system will be transferred to our personnel information system.
5. Your rights
Subject to certain conditions being met, you can also exercise your data protection rights in relation to us: When submitting requests to exercise your rights, you should – wherever possible – address them in writing or via e-mail to Hymer GmbH & Co. KG, info@hymer.com or address them directly to our Data Protection Officer in writing or via e-mail.
For instance, you have the right to obtain from us information about personal data concerning you that is in our storage systems in accordance with the provisions of Art. 15 GDPR (where applicable, subject to the restrictions of Section 34 BDSG-Neu = German Federal Data Protection Act, new version).
At your request, we will rectify any stored data concerning you in accordance with Art. 16 GDPR if the data are inapplicable or inaccurate.
If you so wish, we will erase your data in accordance with the principles of Art. 17 GDPR, unless this is prevented by other legal regulations (e.g. legal record retention obligations or the restrictions imposed by Section 35 BDSG-Neu) or unless we have an overriding legitimate interest (e.g. to defend our rights and claims).
Subject to the conditions of Art. 18 GDPR, you can demand that the processing of your data be restricted.
If your personal data are processed on the basis of legitimate interests pursuant to Art. 6 para. 1 sentence 1 lit. f) GDPR or if they are necessary for the performance of a task carried out in the public interest or in the exercise of official authority, you have the right to object to the processing of your personal data pursuant to Art. 21 GDPR, provided that there are reasons for this arising from your particular situation or the objection is directed against direct advertising. In the latter case, data subjects have a general right of objection, which will be implemented by us without reference to a particular situation.
Subject to the conditions of Art. 20 GDPR, you also have the right to receive your data in a structured, commonly used and machine-readable format or to have the data transmitted to a third party.
In addition, you have the right to revoke your consent to the processing of personal data at any time with effect for the future.
Furthermore, you have a right to lodge a complaint with a data protection supervisory authority (Art. 77 GDPR). Nevertheless, we recommend that you always direct any complaints to our Data Protection Office in the first instance.
